29 Jul 1870 - Lacey v. Hill - Bill of Complaint ⓘ (1870. L. No. 94) against Sir Robert John Harvey Harvey (#4) ►
In essence: this document is a request that the Master of the Rolls (the judge who presides over the Court of Appeal (Civil Division)) consider the matter of the estate of Sir Robert John Harvey Harvey being used to repay creditors of the Bank, Harveys and Hudsons, owned by him and 2 others (Roger Allday Kerrison and Roger Kerrison, both now declared bankrupt). This action being brought by James Wilkins Lacey of Norwich on behalf of himself and other creditors. The prayer is:
That an account may be taken of what is due from the estate of the said testator Sir Robert John Harvey Harvey to the Plaintiff and also of what is due to all other unsatisfied customers of the said testator.
That the real and personal estate of the said testator may be administered by and under the direction of this Honourable Court and that the same may be applied in a due course of administration in payment of what on taking the accounts aforesaid may be found due to the Plaintiff and other unsatisfied creditors of the said testator.
That for the purpose aforesaid the real estate of the said testator may be sold under the direction of this Honourable Court.
That the Plaintiff may have such further or other relief as the nature of the case may require.
This action was taken as the Bank appeared to owe James William Lacey £1,602 19s. ‘for goods sold and delivered’.
Whilst no real connection to the owners of the Poplars at that time can be made it may be reasonable to assume that it might be covered under the ‘other creditors’.
