APPORTIONMENT of the RENT-CHARGE in lieu of TITHES in the Parish of Tharston in the County of Norfolk

Whereas an Agreement for the COMMUTATION of TITHES in the Parish of Tharston in the County of Norfolk was, on the twenty second day of April in the Year One Thousand Eight Hundred and Thirty nine, confirmed by the Tithe Commissioners for England and Wales, of which Agreement, with the Schedule therein composed, the following is a copy:-

an agreement for the Commutation of the Tithes of the Parish of Tharston in the County of Norfolk pursuant to the act for the Commutation of Tithes in England and Wales made and executed at a Parochial Meeting of the Landowners and Tithe Owners duly called and holden in the said Parish and adjourned from time to time and was holden by adjournment on this twenty first day of March one thousand eight hundred and thirty eight by and between The Right Reverent Joseph Lord Bishop of Ely Impropriate [1] Rector of the said Parish of Tharston Sir Robert John Harvey of the Hamlet of Thorpe in the City and County of Norwich Knight his Lordship’s Lessee of the said Impropriate Rectory under a Lease for the Term of twenty one years in which a Rent of less than two thirds of the clear yearly of the Premises comprised therein was reserved and The Reverend John Hirley Sparke of Gunthorpe in the County of Norfolk Clerk The Reverend Edward Bowyer Sparke of Feltwell in the said County Clerk also the said Lord Bishop’s Lessees of the said Impropriate Rectory under a concurrent Lease for the Term of twenty one years in which a Rent of less than two thirds of the Rector and Sir Robert John Harvey and John Henry Sparke and Edward Bowyer Sparke his Lordship’s Lessees as aforesaid are jointly Owners of the Tithes of corn grain and hay of the said Parish under the meaning of the said Act except from the Tithes of corn grain and hay arising from the Lands hereinafter particularly mentioned as rendering Tithes to The Reverend Henry Atkinson Rector of the Parish of Wacton in the said County of Norfolk and to his Lessees The Reverend Ellis Burroughes and The Reverend Walter Burroughes Clerks and The Reverend William Walford Rector of the Parish of Stratton Saint Mary in the said County The Reverend Thomas Howes of Morningthorpe in the County of Norfolk Clerk Vicar of the said Parish and as such Owner of all the Tithes of the said Parish except the Tithes of Corn Grain and Hay and except any part of the Tithes arising from the Lands hereinafter mentioned of rendering Tithes to the said Henry Atkinson and the said Ellis Burroughes and Walter Burroughes and the said William Walford of the one part and the Several bodies Politic and Persons Landowners or Substitutes according to the Provisions of the said Act for Landowners within the said Parish by whom or by whose agents duly authorized in that behalf this agreement is executed and the Interest of which Landowners in the Lands of the said Parish is not less than two thirds of the Lands of the Parish subject to Tithes of the other part

The Parish of Tharston aforesaid contains by estimation one thousand five hundred and eighty two acres and twenty one perches of Land. The whole quantity by estimation in statute measure of Land subject to Tithes within the Parish which is now cultivated as Arable Meadow or Pasture Land or as Woodland or otherwise is as follows namely

No modus or composition real or prescriptive or customary payment is payable instead of all or any of the Tithes of the said Parish except the Custom of delivering or paying the Tithe of Milk (namely by delivering the Milk of every tenth day at the Vicarage House in Tharston aforesaid and except the prescriptive or customary payment of one penny a year called Hearth Silver in lieu of the Tithe of wood cut and burnt in the said Parish but if wood is sold and carried out of the said Parish then the Vicar has the right to the Tithe thereof. None of the Lands of the said Parish are or have been under any circumstances exempt from the payment of any Tithes except as before mentioned and except six acres and fifteen perches of Land in the said Parish of Tharston belonging to Sarah Nasmith Burroughes in the occupation of John Harris and Richard Alexander render Tithes to the said Henry Atkinson and his aforesaid lessees and also except two acrea one rood and thirteen perches of Land in the Parish of Tharston belonging to the Reverend William Boycott in the occupation of Edward Fisher which renders Tithes to the said William Walford and it is hereby agreed that the annual sum of four hundred and twenty pounds by way of Rent Charge subject to the provisions of the said Act shall be paid to the said Lord Bishop and his Lessees and to the successors of the said Bishop instead of the Tithes of Corn Grain and Hay of the Lands within the said Parish subject to Tithes except of the Tithes of corn grain and hay are hereinbefore and hereinafter mentioned as payable to Henry Atkinson and his lessees and the said William Walford and also except the Glebe and that the further sum of fifteen shillings shall be payable by way of Rent Charges in respect of the said Glebe Lands of the Impropriate Rectory when they are not in the ????? or occupation of the Impropriate Rector himself and that the said additional sum of fifteen shillings shall be apportioned upon the said Rectorial Glebe as follows (namely) that the sum of twelve shillings part thereof shall be payable in respect of the Rectorial Tithes and the sum of three shillings the residue thereof shall be payable in respect of the Vicarial Tithes of the said Rectorial Glebe and the further sum on one pound and five shillings shall be payable by way of Rent Charge in respect of the said Glebe Lands of the said vicarage when they are not in the ????? or occupation of the Vicar for the time being which additional sum of one pound and five shillings shall be apportioned upon the said Vicarial Glebe as follows (that is to say) the sum of fourteen shillings part thereof shall be payable in respect of the Rectorial Tithes and the sum of eleven shillings the residue thereof shall be payable in respect of the Vicarial Tithes of the said Vicarial Glebe and it is further agreed that the annual sum of one hundred and twenty pounds by way of Rent Charge (subject to the provisions of the said Act) shall be paid to the said Thomas Howes as Vicar of the said Parish and to his successors instead of all the Tithes as well great as small and instead of Moduses and Prescriptive or Customary payments payable in lieu thereof in respects of the Lands within the said Parish subject to Tithes payable to the said Vicar except the contingent additional Rent Charges which may occur in respect of the Glebe Lands when the same shall not be in the occup[ation of the owners thereof as hereinbefore agreed and provided and it is further agreed that the annual sum of two pounds by way of Rent Charge (subject to the provision of the same Act) shall be paid to the said Henry Atkinson as Rector of the said Parish of Wacton and his lessees and to the successors of the of the said Henry Atkinson instead of the Tithes of the said six acres and fifteen perches of land and that the annual sum of fifteen shillings shall be paid to the said William Walford as Rector of the said Parish of Stratton Saint Mary and his successors instead of the Tithes of the aforesaid two acres one rood and thirteen perches of Land and it is further agreed that the aforesaid Rent Charges shall commence and be computed from the first day of October next following the confirmation of the apportionment from which day the lands included in this agreement shall be discharges from the payment of all Tithes except as excepted in the said Act In witness whereof the said parties to this agreement or there Agents duly authorized in their namesw and on their behalf have hereunto subscribed and set their respective hands and seals at the time in that behalf above written

Now we William Newton of the City of Norwich and Thomas Edwards of Hapton in the County of Norfolk having been duly appointed valuers to apportion the total sum agreed to be paid by way of Rent Charge in lieu of Tithes amongst the several Lands of the said Parish of Tharston do hereby apportion the Rent Charge as follows
